What's
a SOX- Supply Chain Audit? And how it can benefit U.S. importers
and exporters
Sarbanes - Oxley Act, (SOX as it's known),
was put in place to make US Corporations be more protective
of their shareholders' investments. This new law in part states
that the CEO and CFO must both sign off on and can be held
accountable for the following:
• All Financial Statements, both internal and external
such as those published and distributed to shareholders,
• Accounting practices and Standard Operating Procedures,
(SOP's)
• Certification from both internal and external Auditors
validating that SOP
documentation and practices are both legal and accurate.
• The company must make themselves available for scrutiny
by outside Auditors, the SEC and the US Government.
The Bureau of Customs and Border Protection,
(CBP), along with other governmental agencies, (Department
of State, Department of Defense, Department of Commerce, etc.),
have required companies to submit particular paperwork in
order to Import or Export their products in/out of the United
States. Here's how American River International can conduct
a SOX - Supply Chain Audit for your company to insure that
you're insulated from present and future liability ...Among
the processes and documentation we review include, but are
not limited to, the following:
• C-TPAT participation and Audit compliance
• Proper documentation such as: Entry Summary forms-
7501 and 3461
• Customs Valuation Analysis
• Automated Export System (AES)
• Commercial and Pro Forma Invoices
• Certificate of Origin
• Correct HTUS/Schedule B classifications
• Letters of Credit and money transfers
• Applicable Licenses or Permits
• Quota Documentation
• Transfer Pricing Evaluation
• Self-Assessment Review
This Import/Export documentation and related shipping/receiving
SOP's are evidentiary of the information submitted to the
aforementioned Governmental Agencies and Banks/Creditors alike
and authenticates a company's trustworthiness to conduct international
business.
As these processes occur daily in the shipping/received docks
all over the Corporate America landscape, our SOX - Supply
Chain Audit can proactively detect and correct any deficiencies
and liabilities and infuse SOP's into your SOX Act required
process.
When you consider that millions of dollars are expended daily
in this area, and given that these multiple requirements are
monitored to affirm the effective and lawful operation of
this previously unnoticed department, you all but guarantee
that this area will ultimately be an Audit point and every
bit as prosecutorial as misleading Financial Statements.
